The football community is buzzing with rumours of Pitso Mosimane potentially returning to Mamelodi Sundowns. However, a significant legal shadow remains over this possible reunion. The “Siya crew” has provided a fresh update on the ongoing litigation between the coach and his former club.

The Core of the Conflict

The dispute began after Mosimane’s departure in September 2020. He left the Brazilians to join Al Ahly shortly after signing a new four-year deal. This exit triggered a legal claim by the Tshwane giants.

Sundowns are demanding a refund of nearly R8 million. This amount relates to agent commission fees paid in advance to MT Sports, the agency representing Mosimane. The agency is owned by his wife, Moira Tlhagale.

The case focuses on a clawback clause. Sundowns argue they are owed a refund for the period Mosimane was no longer head coach. In September last year, the South Gauteng High Court ruled in favour of the club.

During the proceedings, Tlhagale argued the clause was discriminatory based on her gender and race. However, Judge Shaanaz Mia ruled that the clause applied to the contract regardless of these factors. She stated that Mosimane was aware of the consequences and obligations of the agreement.

The Upcoming Appeal

Despite the previous ruling, the legal battle is far from over. MT Sports filed an appeal through Mabuza Attorneys. Attorney Eric Mabuza has confirmed that the appeal is set to proceed on 14 January.

This legal friction creates a complex backdrop for any professional return. While fans speculate about a coaching comeback, the courtroom remains the current priority for both parties. Navigating a return while in active litigation requires a delicate balance of professionalism and strategy.
